EU and UK: consent first

Article 5(3) of the ePrivacy Directive (and regulation 6 of the UK's PECR) requires consent before storing or reading cookies on a device, unless they are strictly necessary for a service the user asked for. GDPR sets the standard for that consent: freely given, specific, informed, unambiguous — and as easy to refuse as to accept.

California: opt-out

California does not require prior consent for cookies, but covered businesses that use ad pixels for cross-context behavioural advertising must offer a "Do Not Sell or Share" opt-out and honour Global Privacy Control signals.

In the EU, generally yes. The UK has begun relaxing this for some low-risk analytics — check current ICO guidance.

Is a 'by continuing to browse you accept' banner enough?

No. EU/UK consent requires a clear affirmative action.
